General Information
The general family regrouping visa is requested to reside in Spain as a family member
of foreigners who already have legal residence in Spain and who want to exercise the
right to family regrouping.
This type of visa is not issued to family members of citizens of the European Union
or member states of the European Economic Area or Switzerland (see “Short-term visa
(maximum stay of up to 90 days) -> Relatives of EU citizens”).
The following family members can obtain a family regrouping visa:
- The spouse, not separated de facto or de jure, or the person who maintains with
the sponsor an emotional relationship analogous to the marital one (couple
registered in a public registry, as long as the registration has not been
cancelled, or unregistered couple as long as can prove the continuity of a
cohabitation relationship established before the sponsor established his
residence in Spain). Only one spouse or partner can be reunited in Spain.
- The children of the sponsor, the children of the spouse or partner - even those
adopted (as long as the adoption is valid in Spain) - and those legally
represented by the sponsor, minors under 18 years of age or disabled people who
are not objectively capable of providing for their own needs due to their health
status.
- The parents (father or mother) of the sponsor and those of their spouse or
partner, provided that they are dependent on the sponsor, are over 65 years of
age and there are reasons that justify the need to authorize their residence in
Spain. Exceptionally, and for humanitarian reasons, the regrouping of parents
under 65 years of age may be permitted.
